Apple failed to adequately provide warrantied support. Apple in joint agreement with AT&T agreed to replace a defective new device with a New device and with a new warranty and due to extenuating circumstance, was also to include extended Care warranty coverage. Apple did not replace item with a new item and did not replace item with an authorized device. Device used in exchange has been proven to have been out of Apple ownership and inventory and in the ownership of an employee prior to being used to facilitate the exchange. This was only discovered 90 days after the exchange when Proof of Ownership/Warranty was demanded. A document Apple actively refused to provide up to that point. It was discovered when the document was issued, that the device was listed in the ownership of the store employee and not the consumer(myself). This is a deceptive practice to which I inquired of Apple as to the validity of the warranty as "assigned" or "transfered". Apple refused to acknowledge the exchange/transfer. Apple and AT&T both refuse to honor the warranty with a valid replacement. Apple refused, after the fact, to include the Extended Care. Both vendor and manufacturer were notified of original defects in July and August 2010 (there were two occurrences of defects, one of which had already been replaced). Both were notified within days of discovering defects and both approximately within five days of receiving device. In addition, Apple tech support also deemed product defective after a consultation and indicated the necessity of replacement. At no time was it ever discussed, disclosed, or agreed to that the replacement item can be a previously owned (used) item. Also never discussed, disclosed, or agreed to that the warranty could be assigned from another individual. After expressing to Apple the inconsistency with the Proof of Warranty document, they altered the name to mine but made no change to the factual inconsistency of the transaction (warranty effective date). Further, the 3rd party individual was also an Apple employee which complicates matters further in that Apple now has two conflicting warranty effective dates represented in the document and on their website. At no time did Apple ever procure proper consumer information to validate the device and the warranty. Apple continues to assert the device was valid for exchange but refused to provide proper proof and documentation. Apple's "word" cannot be relied upon. Based on the falsifications I can back-up with the documentation I have received, Apple runs the company with an acute lack of ethical integrity. It is unfortunate that I must give it at least one star. From my experiences, they do not qualify to earn as much.
