Customer Complaint

Summary - Consumer alleges the company has charged her account without her consent.
Complaint Description
Consumer alleges the company has charged her account without her consent. She signed up to receive information on starting a home-based business for a charge of $2.97. This amount was charged to her card on 02/08/10. On 02/11/10 her card was charged $139.95. She had no knowledge of or agreement to this charge. Her husband contacted the company on her behalf and was informed that in the fine print she agreed to this charge if she did not cancel within 3 days. She could not read the fine print as her primary language is Spanish and she has a limited ability to read English. She feels that this is clear misrepresentation as the charge was left hidden in the fine print.
Resolution Sought
Consumer is seeking a full refund of the $139.95 charge and cancellation of any account in her name with the company.

Response
Thank you for your correspondence in connection with the above-referenced matter. It is clear from the text of the complaint that all the information was not provided by the complainant in regards to the program was signed up for and the requisite charges for that program, and several facts have been omitted that once revealed will hopefully clear up this matter. The Internet Cash Machine (ICM) is a turn key business opportunity that offers prospective clients the ability to create single product websites, as well as Mall Webstores which comes pre-stocked with products, some of which can be sold with no product cost to the merchant. The websites are easily built with a few clicks of the mouse, yet are highly customizable for advanced users. The websites are tied into a network of drop-shippers and fulfillment center making it easy for clients to select products and deliver them to their clients without handling them. Included in the program is a mall webstores that ties all of the client's products together allowing them to market a variety of products through an internet mall web site. Internet Cash Machine also offers ICM clients merchant accounts with the ability to accept credit cards and ACH services Internet Cash Machine is a membership site that provides users with all the tools and information necessary to learn how to post websites and webstores and launch products for auction on eBay to make money online. On the credit information page, the terms and conditions of the progam are noted on the page in several different areas. First, there is a link on the bottom of the page for the Terms and Conditions. Second, the Terms and Conditions and charges for the program are listed on the page, directly to the left of the "Rush My Order" button. Those terms and conditions and charges for the service clearly state that there are 3 different charges for this program. The first is the initial charge of $2.97 for processing of the account. The $2.97 charge provides the customer with access to the service for a 3 Day Trial Period. The 3 day period provides the customer with access to the service so they can ascertain if they would like to continue with the service and incur the additional charges for the service. After the 3 day trial period has expired, as the terms clearly state, the customer is then charged the second charge, which is a one-time $139.95 charge for the service membership. The customer then has access to the full service until they elect to cancel the service. Each month that the service is active the customer will be charged a monthly mainitenance fee of $4.95. In addition to clearly spelling out each fee required for the service, we provide the number for the customer to call to cancel this account. All the program costs, charges, terms, conditions and cancellation procedure are cleary spelled out on the page. There can be no question that ICM has taken every step to assure that all the terms and condtions are displayed multiple times throughout the signup process and after the signup is complete. For any customer to state that, "they were not made aware" or "did not see" or "did not authorize the charges" about the pending charges for the service, would be a mistatement of the obvious facts. We have terminated this customers account and no further charges will be conducted on their account. The customer can keep any materials that were received as our gift.

It is obvious that this company is NOT going to refund the sizeable amount of $139.95 yet no one in this family has used the item or its related products. The charge of $2.97 is what was accepted as that is the amount advertised in big bold flashing English text. The secretive $139.95 have since changed theirs collective minds. Our only recourse now, is to challenge them legally via BBB and our bank.

Summary - My husband saw an ad for them and it said that we only charge shipping for the supplies which was $2.97.
Complaint Description
My husband saw an ad for them and it said that we only charge shipping for the supplies which was $2.97. They did not have any small print that said they would be charging 139.95 right away so they screwed us up with our bank and then they kept taking it out and then giving us the money back then they would take it out again and they did this about 3 times. Then I had a guy call me and tell me that in order to sell we need to sign up for credit cards.
Resolution Sought
I would like them to refund my money of $139.95 and the 22.00 I had to take out of my own pocket to list their stupid items on eBay.

Summary - This company has a website to promote their business. You pay $2.97 to get the 3 day free trial kit. You have no clue what it you will be doing.
Complaint Description
The website has no information on what you will be doing on the Internet. From the information provided, I thought you might be setting up webpage for other businesses so I sent them my credit card # for the $2.97 free trial and have received nothing. They have charged my card another $139.95 for the kit I have never received. I did receive an email with a log in and password and went into that site only to find they wanted my SSN, bank account #, driver's license #. I quit entering the information until I received more information about the company by mail. I called to cancel and they told me they could not refund my $139.95 because it was past the 3 days after I signed up. This is false advertising and completely unethical to ask people for that kind of information.
Resolution Sought
I would like them to cancel my subscription and refund my $139.95
